After all, and HMG have been bloody clever about this, the defence is for "Airsoft Skirmishers". But because its a Defence by Regulation, not an Amendment, the burden of proof falls on *us* to prove that we havent broken the law, not up to the CPS to prove we have broken the law. Little change in words there, but a big difference when you're in front of the beak!

Guy, you don't have to have a card at all. But as Kermit says, it's up to you to prove you have a defence. An organised scheme such as the card is the easiest way (as proposed at the mo) but that is not to say it's the only way, not doubt others will come along...

Ah good, exactly what I thought. Broadens it out nicely - would have been easier to chuck it in with the Act though as it is pretty much the same as reenactors/TV/film concession!

Not far off, I listened/watched all the debates in the Commons and Lords, read Hansard and now latest regs. Apart from my vested interest it was very interesting to see how politicians and governments get stuff wrong (knowingly or unknowingly) and carry on regardless ..... oops, political debate - must .stop. now.
Pleased to say I haven't clapped eyes on Kermit's bed, nor his on mine.

I already had a rant on another site so I won't bore you guys with it but what a FUBAR (again). Why the govt doesn't ever think these things through is beyond me - just get someone like UKASGB to set up a member card scheme and your away. BSAC did it for me as a diver and it was easy to join and get a ticket so at least someone knew that I am qualified to handle a variety of potentially danergous gases!

i hate all id scemes,
i dive too , and due to the fact i only do it once in a while, i RESENT haveing to falseify a dog log book just to get the gear.
if you dont have an up to date log book, with frequent dives, your told you need to do more "refreshers", what a load of bollox
ive had to make up and log non existent dives just to hire gear.

Seems redwolfairsoft is putting up a 5% sale for us pre vcr bill 1st october. heard so much rubbish about this and mis information what exactly cant we do post october 1st?

Redwolf? Can't blame them for making a short term buck out of the situation - sales will drop like a stone post 1st Oct (no under 18 sales, no collector sales, severely resticted sales to airsofters).

To to sum up, from Oct 1st it is ILLEGAL to Sell, Manufacture or Import "Realistic Imitation Firearms". .
This is the bit that's really irritating me, I want to buy a couple of Warren's GPMGs for the Land Rover, however if I'm not allowed to sell them on it could be a bit of a sod if I ever have to stop Airsofting for whatever reason. ![]()
There should be some provision for us to sell weapons back to a dealer.

1. we can import if we can provie we're a member of the exemption ie by being identified by a airsoft site thats registered etc?
2. how are 2nd hand in country sales handled? ie if i bought a gun from someone on here?

I've been looking into this due to my potential problem in my post above. I don't think we'll be allowed to sell guns second hand post October 1st...

I may be wrong but when I was looking into this I got the impression you will be able to sell to airsoft retailers, however that’s not necessarily a good thing as you’re not going to get the same price as selling privately

Second Hand sales.
We appreciate the importance of these to the community. Any seller will be obliged to ensure that the purchaser is entitled to the Defence before selling. Remember the offence created in the Act is the sale, manufacture or importing of a realistic imitation firearm. The precise mechanisms whereby second hand sales are to be facilitated are still under discussion. For instance, UKARA might make available to all major UK forums a log on which will allow them to perform the necessary check for their members. It may be possible to allow players registered on the UKARA database a limited number of queries to enable person to person sales. Regardless of the 'how' all participants will be required to excercise a responsible attitude and abide by any rules set in place. Individual UKARA retailers are free to offer such a check as a service to their customers and it is up to them whether or not they charge for this.
This is part of a posting about the latest state of play with the implementation of the VCR act.

1) If you can prove that you qualify for the defence then yes, you can import. Legally.
The big question, as yet unresolved, is how this will be practically implemented. Will HMR&C impound the package and ask you to provide proof, will they impound and make things so difficult that it's not worth the hassle of importing, will they agree to access a national database and do a check on you, will the legwork be passed to the courier to prove the validity, will couriers access a national database scheme?
Thing is, as the Government has left things right to the last minute and given no one a change to have an accepted scheme in place in time for the ban, importing will be very fraught in the next weeks and months until this is sorted.
Sure as hell, there will be duty paid on all imports now as HMR&C has a new reason for inspecting your packages - not just tax raising but crime prevention too.
2) 2nd hand sales. As Pete59 shows in his quote, unless you have a defence then you can neither buy nor sell RIFs - which covers all airsoft guns (well, guns that we are interested in anyway). So, to sell your RIF you must have a defence yourself and make sure the purchaser has too. Otherwise you are breaking the law.
Once again, implementation rears it's head. It's reasonably easy to establish the facts in a face to face transaction. You could of course sell to a retailer, though that doesn't sound financially worthwhile unless it's P/E. Or you could make use of a national database to establish bone fide of both buyer and seller. Except there isn't one. Yet.
The big problem in all this is we still don't know exactly what the government expects from us by way of proof of eligibility to the legal defence. You are required to make 'reasonable' checks on your purchaser, a typically loose legal term that requires a court to decide on it's meaning in context with the case before the court.
Like it or not, the simplest and easiest way to prove you are able to qualify for legal defence to buy, sell, import or manufacture would be a single national card/database scheme. As yet there is nothing in place except for ad hoc skirmish site card schemes so, for the next few months anyway, buying and selling kit is going to be tricky to say the least.
Bright note: Sales of RIFs will be banned for under 18s, regardless of status, and retailers must check on over 18s eligibility to buy. If the Trading Standards and Police do their job robustly it means as from 1st Oct no more realistic springers being sold on market stalls and internet (although expect to see stalls full of clear plastic MP5's and Glocks!
).

Their is no mention of airsoft, so mayne some of you might like to join a re-enactment group or start a Film company because that looks like the only way to get a RIF as of today. It might change befour next month but I doubt it. Hope this helps.
